DOMESTIC VIOLENCE AND INJUNCTIONS |
If you are in a situation with domestic violence or harassment you can apply for an Injunction. There are two types of Injunction:
A Non-Molestation Injunction - this prohibits violence against another person, harassing, molesting or threatening them with violence. |
An Occupation Order, which prohibits a person from coming within a stated radius of home. |
The court may include a Power of Arrest to an Order, therefore if the Order is breached the police can arrest.
An application is made to the court, in urgent cases the application may be heard without notifying the other party.
