These fees apply where your claim is in relation to an unpaid invoice which is not disputed and enforcement action is not needed.
If the other party disputes your claim at any point, we will discuss any further work required and provide you with revised advice about costs if necessary, which could be on a fixed fee (e.g. if a one off letter is required), or an hourly rate if more extensive work is needed.
Our initial fee of £400 plus VAT (@ 20%) covers :
1. Taking your instructions and reviewing documentation.
2. Undertaking appropriate searches.
3. Sending a letter before action.
4. Receiving payment and sending onto you, or if the debt is not paid, seeking further instructions.
If the debt is not paid and you wish us to draft court proceedings, our fixed fee of £600 plus VAT (@ 20%) covers:
1. Preparing Claim Form and Particulars of Claim.
2. Issuing claim.
3. Entering Judgment in default of an Acknowledgment or Defence being filed.
The Court fee payable will depend on the amount of the claim and the current rates are:
Debt Value |
Court Fee |
|
Up to £5,000 |
£35 to £205 |
|
£5,001 - £10,000 |
£455 |
|
£10,001 - £100,000 |
5% of value of claim |
|
Interest claimed on the initial debt may take the value into a higher banding, with a higher Court Fee being payable.
The costs stated above do not include:
1. Enforcement action, such as the bailiff, if needed to collect your debt.
2. Dealing with any counterclaim from the debtor.
The timescales for any dealing with a debtor can be a few weeks if they pay promptly to many months if we need to issue a claim through the courts and seek enforcement of the payment.
